1. Introduction and Acceptance

Welcome to ECNEXUS ("Platform", "we", "us", "our"). These Terms of Service ("Terms") govern your use of our website, services, and platform located at ecnexus.club and any related services.

ECNEXUS is a decentralized freelance marketplace that connects buyers and sellers for digital services, with payments processed through cryptocurrency. By accessing or using our Platform, you agree to comply with these Terms.

2. Eligibility

To use ECNEXUS, you must:

• Be at least 18 years of age or the legal age of majority in your jurisdiction
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using our services under applicable laws
• Provide accurate and complete registration information

3. Account Registration and Security

When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Immediately notify us of any unauthorized access
• Accept responsibility for all activities under your account

You are solely responsible for maintaining the confidentiality of your account and wallet information.

4. Platform Services

4.1 Marketplace

ECNEXUS provides a platform where:

• Sellers can list and offer digital services ("Gigs")
• Buyers can purchase these services
• Both parties can communicate through our messaging system
• Payments are processed through cryptocurrency

4.2 Role of ECNEXUS

ECNEXUS acts solely as an intermediary platform. We do not:

• Guarantee the quality, safety, or legality of services offered
• Guarantee that sellers will complete orders satisfactorily
• Endorse any user, seller, or their services
• Act as an employer or agent of any user

5. Payments and Fees

5.1 Cryptocurrency Payments

All transactions on ECNEXUS are processed through cryptocurrency payments. By using our payment system, you acknowledge:

• Cryptocurrency transactions are irreversible once confirmed on the blockchain
• You are responsible for ensuring correct wallet addresses and payment amounts
• Exchange rate fluctuations may affect the final value of transactions
• We are not responsible for losses due to incorrect payment information

5.2 Platform Fees

ECNEXUS charges a service fee on completed transactions. Current fee structure:

• Platform fee: 5% of the transaction value (deducted from seller earnings)
• Sellers receive 80% of the order value upon completion

5.3 Escrow Protection

Payments are held in escrow until:

• The buyer marks the order as complete, OR
• The automatic release period expires after delivery (3 days)

6. Prohibited Conduct

Users are strictly prohibited from:

6.1 Communication Violations

• Sharing phone numbers, email addresses, or any personal contact information
• Attempting to communicate outside the ECNEXUS platform
• Sharing social media handles (WhatsApp, Telegram, Instagram, etc.)
• Requesting or offering to transact outside the platform

6.2 Payment Violations

• Requesting payments through external methods (PayPal, bank transfer, Pix, etc.)
• Attempting to circumvent platform fees
• Money laundering or fraudulent transactions

6.3 Service Violations

• Offering illegal services or content
• Delivering work that infringes intellectual property rights
• Misrepresenting skills, qualifications, or service quality
• Using fake reviews or manipulating ratings

6.4 Platform Abuse

• Creating multiple accounts
• Automated access or scraping
• Distributing malware or harmful content
• Harassment, discrimination, or abusive behavior

7. Dispute Resolution

In case of disputes between buyers and sellers:

• Users should first attempt to resolve issues through direct communication
• If unresolved, either party may open a dispute through the platform
• ECNEXUS will review disputes and make decisions based on available evidence
• Our dispute resolution decisions are final and binding

ECNEXUS reserves the right to withhold funds during dispute investigation.

You agree to indemnify, defend, and hold harmless ECNEXUS, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Your transactions with other users

10. Intellectual Property

The ECNEXUS name, logo, and all related marks are our trademarks. Users retain ownership of their content but grant ECNEXUS a license to use, display, and distribute such content on the platform.

11. Account Termination

We may suspend or terminate your account at our sole discretion, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Repeated policy violations
• Any reason we deem necessary to protect the platform or other users

Upon termination, your right to use the Platform ceases immediately. Pending balances may be forfeited in cases of fraud or serious violations.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting. Continued use of the Platform after modifications constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
